Notice to Borrower(s) Regarding Commercial Industries' Homebuyer Privileges Program

Jackson National Bank and Jackson National Bank, fsb (collectively, "Jackson National") participate in the Commercial Industries' Homebuyer Privileges Program (the "Program"). Participating in the Program allows Jackson National to pass the benefits of the Program to our borrowers. Our borrowers can receive valuable discounts and other benefits from participating vendors. By purchasing goods or services through the Program, you acknowledge and agree that all offers for products and services under the Program are made by the individual vendors, and the only warranties, if any, applicable to any good or service purchased under the Program will be provided by the vendor.

JACKSON NATIONAL HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO ANY GOOD OR SERVICE AVAILABLE THROUGH THE PROGRAM, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF NONINFRINGEMENT, TITLE, MERCHANTABILITY, MARKETABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL JACKSON NATIONAL BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, SAVINGS, DATA OR USE, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY (INCLUDING NEGLIGENCE OR STRICT LIABILITY), ARISING OUT OF THE PROGRAM.

Commercial Industries' Homebuyer Privileges Program

We (Jackson National) are part of Commercial Industries' Homebuyer Privileges Program. This Program gets you valuable discounts and other benefits from participating sellers.

In the Program, the sellers offer the goods and services, not us. Only the sellers can offer warranties on the goods and services, not us.

But warranties can be important, so there are some legal details we need to spell out.


We make no express warranties.

The products are as is.

We deny all implied warranties. This isn't all of them, but for example, we deny warranties of noninfringement, title, merchantibility, and fitness for a particular purpose.

We're not liable for any claims for money. This isn't all of them, but for example, we're not liable for any of these damages: direct, indirect, consequential, special, incidental, or punitive.

We're not liable for lost profits, lost savings, lost data, or lost use

No matter how the damages or losses were caused and no matter what theory you might use, we're not liable.
